Another week has flown by and again we are already in front of the computer typing a new newsletter. This week we have been able to add 9 new shows in the archives page -- They are Rock-it Radio shows #2185 to #2194. Show #2187 was a Roy Harrow show and was pulled within hours of airing due to the CD having been cracked during shipping -- but it will be back in a couple of week's -- with a fresh Ear Full of Rock and Roll. Also, this newsletter we have some winner's to be announced. And we have a few more new 'vintage' broadcasts that have been re-mastered in the Rock-it Radio launching pad. Online Radio Is Saved; SoundExchange Will Not Enforce New Royalty Rates on Sunday By Eliot Van Buskirk July 12, 2007
At today's Congressional hearing about the new rates for online radio that would essentially destroy it (as readers of this blog already know), SoundExchange, which was scheduled to receive the new royalty payments on Monday morning (since the enforcement date falls on a Sunday), made a startling statement. The SoundExchange executive [Jon Simson, executive director] promised -- in front of Congress -- that SoundExchange will not enforce the new royalty rates. Webcasters will stay online, as new rates are hammered out.
I just spoke with Pandora founder Tim Westergren, who expressed relief that Pandora wouldn't have to shut down on Sunday in response to the new rates. He said, "It was getting pretty close. I always had underlying optimism that sanity was going to prevail, but I was beginning to wonder."
He said everyone who called their Congress person about this should feel that they had an effect on the process: "This is a direct result of lobbying pressure, so if anyone thinks their call didn't matter, it did. That's why this is happening." The flyer DiMA distributed to Congress today probably helped a bit too, but overall, it appears Congress intervened due to pressure from web radio listeners.
Funnily enough, Westergren told me this mere hours after a representative of SoundExchange said that the new rates are "etched in stone." Evidently not.

Update: Another source -- close to the situation although not inside today's closed-door hearing -- confirmed the following: Pandora was there; "progress was made"; the minimum fees are indeed off the table; and SoundExchange and the webcasters that were part of the Copyright Royalty Board hearings are going to have another chat about the rates.
However, the source said the big question right now is whether webcasters not part of the CRB hearing might still have to pay the rates set by the board, minus the minimum fees.
Basically, this news qualifies as a reprieve, but internet radio won't be truly saved until negotiations result in a workable royalty rate.
Another Update: This story has been confirmed by Kurt Hanson of RAIN.

Westergren had more to say, lending insight into a process that was largely opaque to non-participants. Apparently, the per-channel minimum fees mandated by the Copyright Royalty Board were never taken very seriously by those involved. They've now been taken off the table completely, saving Pandora, Live365, and other multicasters from their most imminent threat. Instead, per-station minimums will be capped at $50,000 per year.
"No one thought those per station fees were remotely rational. It only makes sense that they're being taken off the table."
As for the Copyright Royalty Board? They're entirely cut out of the process, having set the rates and then refused a rehearing. Going forward without the royalties being collected, SoundExchange and webcasters will negotiate a new royalty rate with Congress looking over their shoulder -- "and last but not least, the public looking over Congress's shoulder." Alternatively, Congress now has time to consider the Internet Radio Equality Act, which would set webcaster royalties at 7.5 percent of revenue and allow them to continue operating pretty much as they have been.
Either way, this is a big win for webcasters and their listeners. Again, this is a reprieve, and internet radio can't be considered saved until new rates are set that everyone can live with. GOURMET COFFEE INTRODUCTORY DEAL !!!

On this program, host Lane Quigley presents the songs you know by the artists you know -- but NOT the versions that you know. During recording sessions, producers would often have the artists perform several takes of the songs that they intended to release as singles, then they would select the rendition that they thought was the best for release. No word has really been received on his condition or how long he will be hospitalized. Apparently Rosie Hamlin of the group -- Rosie and the Originals ... (Hit Song -- Angel Baby) is facing tough times, so a benefit concert is being held for her on July 8, 2007 at Pearson Park in Anaheim, California from 5 pm to 8 or 9 with acts like Jewel Akens, Tony Allen, Virgil Johnson of the Velvets, Jimmy Pipkin of the Gallahads, Al Wilson, Thee Midniters and many more.
Rock-it Radio DJ Steve Propes will be one of the Masters of Ceremonies for this event. For further information you can contact Steve at: 45sshow@rockitradio.net MIRACLES DO HAPPEN! -- FOLLOW UP ON JIMMIE RODGERS Last week we reported the upcoming serious surgery that 50's Recording artist Jimmie Rodgers had to undergo. Earlier this week we received further word on Jimmie Rodgoers from his son Michael and we relay the following good news... Miracles do happen and one happened this morning. The surgery began this morning with a group prayer with the Dr's and family. About four minutes after beginning, the Dr's pulled back the scalp to reveal the plate. When they did that the plate literally jumped up away from his head. The Dr's, five in all a Neuro Surgeon, Two Plastic Surgeons, Two Stem Cell Specialists and the rest of the team began to clean the plate and lift it away from the head. It released itself and came away clean. On the video we could hear the Neuro Surgeon say Oh my God look at that. How did that get there? Under the plate was revealed a complete and intact skull bone where three months ago there was none. The entire hole in the bone which was an eight inch by six inch oval had grown completely closed with a new skull bone which was smooth and shaped to match the existing skull. It was perfect in every way and was the same thickness as the other bone. The Dr's said that in 35 years of surgery they had never seen anything like it. They did not need to recreate a new skull bone at all. Dad was completely healed and made whole again after 40 years. The stem cell Dr's sprayed a stem paste made from Dads blood over the skull bone and onto the skin flap and the Plastic Surgeons closed him up. The stem paste will keep him from swelling and will encourage skin growth onto the bone. The entire procedure took about 28 minutes and after one hour in recovery Dad walked out of the room on his own. He is coming home tomorrow. It was an amazing day. Prayer is so powerful. Remember, if the show that you want to hear is getting close to the bottom of the list of radio shows, you should tune in as soon as you can. These shows to have a high audio quality require a lot of internet bandwidth and memory. And currently we can only afford the 16 latest shows online here at Rock-it Radio. So, when a new show is put online it knocks the oldest one off the Rock-it Radio archives page. Usually a show will at least last 10 to 12 days, once it is placed in the archives.
